Digital evolution, accelerated by the adversities faced during the pandemic (COVID-19), has facilitated the internationalization of business, enabling immediate virtual interaction between parties located in different countries.
In this way, negotiations that used to take months to complete can now be discussed and validated in a matter of hours, thanks to technology, expanding the search for new markets beyond national borders.
It turns out that even with technological advances, including virtual translators and artificial intelligence, the parties involved encounter significant linguistic and cultural challenges in negotiating and formalizing contracts.
As a result, bilingual legal professionals are essential to ensure clarity, accuracy, and legal effectiveness in the drafting, mediation, and execution of business contracts.
Just as legal language confuses and intimidates the general population, who are native speakers of the local language but unfamiliar with the technical language of law, foreign professionals face this difficulty to an even greater extent. It is not enough to be fluent and technically proficient in the local language; it is necessary to understand the technical specifics of each area of commercial activity, in addition to the regionalisms inherent to each nation.
Contracts require terminological and legal precision that complicates communication between the parties, given that linguistic ambiguities can lead to disputes and losses, and literal translations can distort important clauses.
In this way, bilingual specialists act as cultural mediators, not just translators, adapting terminology to the needs of each client and respecting the particularities of each culture involved in the negotiation.
In addition, they have the ability to understand legal and commercial nuances in different jurisdictions, and can easily navigate the rules established by international organizations when necessary, with a view to globalizing the basic principles of international contracts, as is the case, for example, with the International Institute for the Unification of Private Law (Unidroit), based in Rome, to which Brazil is a signatory.
In addition to facilitating negotiations, avoiding misunderstandings, and promoting empathy between the parties, the advantages of using bilingual professionals include reduced legal risks; streamlined negotiations and contract drafting; greater trust between the parties involved; and adaptation to the legal and commercial context of each country.
A good bilingual professional is someone who combines technical skills, such as legal training, fluency in relevant languages, and knowledge of technical terminology and comparative law, with interpersonal skills and cultural sensitivity.
The use of these professionals allows not only for the correct formalization of the business, but also for contractual longevity, generating greater efficiency and effectiveness in hiring.
Given the growing internationalization of business driven by digital evolution, it is clear that bilingual legal professionals offer an indispensable strategic advantage. More than just translators, these professionals act as true legal and cultural interpreters, ensuring that business contracts transcend linguistic and regulatory barriers with precision, clarity, and security.
By integrating technical skills and intercultural sensitivity, they contribute directly to the strength of international trade relations, mitigating risks, promoting mutual trust, and ensuring that agreements signed accurately reflect the wishes of the parties involved.
Therefore, investing in specialized mediation is investing in the sustainability and success of global partnerships. In an increasingly interconnected market, this is an essential step for companies that want to prosper safely and soundly.
