\n\t\t\t\t\t\t\t\t\tEntenda a Consigna\u00e7\u00e3o em Pagamento Extrajudicial segundo o Novo C\u00f3digo de Processo Civil<\/em>\r\n\r\n \r\n\r\nEm nosso escrit\u00f3rio de advocacia, entendemos a import\u00e2ncia da consigna\u00e7\u00e3o em pagamento extrajudicial conforme o novo C\u00f3digo de Processo Civil. Esse procedimento especial, embora mantenha algumas similaridades com o procedimento comum, apresenta diferen\u00e7as significativas que devem ser compreendidas.\r\n\r\nA consigna\u00e7\u00e3o em pagamento extrajudicial \u00e9 uma op\u00e7\u00e3o para o devedor ou um terceiro depositarem a quantia devida em um estabelecimento banc\u00e1rio oficial ou privado, quando n\u00e3o h\u00e1 um estabelecimento oficial dispon\u00edvel na cidade. Esse procedimento pode ser utilizado para o pagamento de quantias em dinheiro, inclusive alugu\u00e9is e seus encargos.\r\n\r\nA comunica\u00e7\u00e3o do dep\u00f3sito ao credor \u00e9 realizada por meio de carta com aviso de recebimento, concedendo-lhe um prazo de 10 dias para manifestar sua recusa por escrito. O dep\u00f3sito deve ser feito no banco localizado no lugar do pagamento, e a comunica\u00e7\u00e3o e a recusa devem ser dirigidas ao pr\u00f3prio banco.\r\n\r\nAp\u00f3s o prazo de manifesta\u00e7\u00e3o de recusa, se o credor n\u00e3o se opuser ao pagamento, o devedor fica liberado da obriga\u00e7\u00e3o, e o comprovante de dep\u00f3sito serve como prova de quita\u00e7\u00e3o. O valor depositado fica \u00e0 disposi\u00e7\u00e3o do credor, que pode retir\u00e1-lo a qualquer momento.\r\n\r\nCaso o credor recuse o pagamento, o devedor tem um prazo de 1 m\u00eas para ingressar com a a\u00e7\u00e3o de consigna\u00e7\u00e3o judicial. \u00c9 importante ressaltar que esse prazo n\u00e3o \u00e9 decadencial ou prescricional, mas sim uma forma de preservar a efic\u00e1cia do dep\u00f3sito extrajudicial. Se a a\u00e7\u00e3o for proposta dentro do prazo, o devedor fica livre do valor depositado. Caso contr\u00e1rio, o valor poder\u00e1 ser levantado pelo devedor, e ele dever\u00e1 entrar com a a\u00e7\u00e3o de consigna\u00e7\u00e3o judicial.\r\n\r\n\u00c9 fundamental ingressar com a a\u00e7\u00e3o dentro do prazo estipulado, pois ap\u00f3s o vencimento desse prazo, o credor entrar\u00e1 em mora por n\u00e3o ter aceitado o pagamento. Nesse caso, os juros incidir\u00e3o apenas conforme as taxas banc\u00e1rias, e n\u00e3o conforme o contrato original. Digital evolution, accelerated by the adversities faced during the pandemic (COVID-19), has facilitated the internationalization of business, enabling immediate virtual interaction between parties located in different countries.<\/p>

In this way, negotiations that used to take months to complete can now be discussed and validated in a matter of hours, thanks to technology, expanding the search for new markets beyond national borders.<\/p>

It turns out that even with technological advances, including virtual translators and artificial intelligence, the parties involved encounter significant linguistic and cultural challenges in negotiating and formalizing contracts.<\/p>

As a result, bilingual legal professionals are essential to ensure clarity, accuracy, and legal effectiveness in the drafting, mediation, and execution of business contracts.<\/p>

Just as legal language confuses and intimidates the general population, who are native speakers of the local language but unfamiliar with the technical language of law, foreign professionals face this difficulty to an even greater extent. It is not enough to be fluent and technically proficient in the local language; it is necessary to understand the technical specifics of each area of commercial activity, in addition to the regionalisms inherent to each nation.<\/p>

Contracts require terminological and legal precision that complicates communication between the parties, given that linguistic ambiguities can lead to disputes and losses, and literal translations can distort important clauses.<\/p>

In this way, bilingual specialists act as cultural mediators, not just translators, adapting terminology to the needs of each client and respecting the particularities of each culture involved in the negotiation.<\/p>

In addition, they have the ability to understand legal and commercial nuances in different jurisdictions, and can easily navigate the rules established by international organizations when necessary, with a view to globalizing the basic principles of international contracts, as is the case, for example, with the International Institute for the Unification of Private Law (Unidroit), based in Rome, to which Brazil is a signatory.<\/p>

In addition to facilitating negotiations, avoiding misunderstandings, and promoting empathy between the parties, the advantages of using bilingual professionals include reduced legal risks; streamlined negotiations and contract drafting; greater trust between the parties involved; and adaptation to the legal and commercial context of each country.<\/p>

A good bilingual professional is someone who combines technical skills, such as legal training, fluency in relevant languages, and knowledge of technical terminology and comparative law, with interpersonal skills and cultural sensitivity.<\/p>
