Esse procedimento especial, embora mantenha algumas similaridades com o procedimento comum, apresenta diferen\u00e7as significativas que devem ser compreendidas.\r\n\r\nA consigna\u00e7\u00e3o em pagamento extrajudicial \u00e9 uma op\u00e7\u00e3o para o devedor ou um terceiro depositarem a quantia devida em um estabelecimento banc\u00e1rio oficial ou privado, quando n\u00e3o h\u00e1 um estabelecimento oficial dispon\u00edvel na cidade. Esse procedimento pode ser utilizado para o pagamento de quantias em dinheiro, inclusive alugu\u00e9is e seus encargos.\r\n\r\nA comunica\u00e7\u00e3o do dep\u00f3sito ao credor \u00e9 realizada por meio de carta com aviso de recebimento, concedendo-lhe um prazo de 10 dias para manifestar sua recusa por escrito. O dep\u00f3sito deve ser feito no banco localizado no lugar do pagamento, e a comunica\u00e7\u00e3o e a recusa devem ser dirigidas ao pr\u00f3prio banco.\r\n\r\nAp\u00f3s o prazo de manifesta\u00e7\u00e3o de recusa, se o credor n\u00e3o se opuser ao pagamento, o devedor fica liberado da obriga\u00e7\u00e3o, e o comprovante de dep\u00f3sito serve como prova de quita\u00e7\u00e3o. O valor depositado fica \u00e0 disposi\u00e7\u00e3o do credor, que pode retir\u00e1-lo a qualquer momento.\r\n\r\nCaso o credor recuse o pagamento, o devedor tem um prazo de 1 m\u00eas para ingressar com a a\u00e7\u00e3o de consigna\u00e7\u00e3o judicial. \u00c9 importante ressaltar que esse prazo n\u00e3o \u00e9 decadencial ou prescricional, mas sim uma forma de preservar a efic\u00e1cia do dep\u00f3sito extrajudicial. Se a a\u00e7\u00e3o for proposta dentro do prazo, o devedor fica livre do valor depositado. Caso contr\u00e1rio, o valor poder\u00e1 ser levantado pelo devedor, e ele dever\u00e1 entrar com a a\u00e7\u00e3o de consigna\u00e7\u00e3o judicial.\r\n\r\n\u00c9 fundamental ingressar com a a\u00e7\u00e3o dentro do prazo estipulado, pois ap\u00f3s o vencimento desse prazo, o credor entrar\u00e1 em mora por n\u00e3o ter aceitado o pagamento. Nesse caso, os juros incidir\u00e3o apenas conforme as taxas banc\u00e1rias, e n\u00e3o conforme o contrato original. Esse procedimento especial, embora mantenha algumas similaridades com o procedimento comum, apresenta diferen\u00e7as significativas que devem ser compreendidas. A consigna\u00e7\u00e3o em pagamento extrajudicial \u00e9 uma op\u00e7\u00e3o para o devedor ou um terceiro depositarem a quantia devida em um estabelecimento banc\u00e1rio oficial ou privado, quando n\u00e3o h\u00e1 um estabelecimento oficial dispon\u00edvel na cidade. Esse procedimento pode ser utilizado para o pagamento de quantias em dinheiro, inclusive alugu\u00e9is e seus encargos. A comunica\u00e7\u00e3o do dep\u00f3sito ao credor \u00e9 realizada por meio de carta com aviso de recebimento, concedendo-lhe um prazo de 10 dias para manifestar sua recusa por escrito. O dep\u00f3sito deve ser feito no banco localizado no lugar do pagamento, e a comunica\u00e7\u00e3o e a recusa devem ser dirigidas ao pr\u00f3prio banco. Ap\u00f3s o prazo de manifesta\u00e7\u00e3o de recusa, se o credor n\u00e3o se opuser ao pagamento, o devedor fica liberado da obriga\u00e7\u00e3o, e o comprovante de dep\u00f3sito serve como prova de quita\u00e7\u00e3o. Compensa\u00e7\u00e3o mensal\u00a0\u2014 acordo t\u00e1cito ou verbal (art. 59, \u00a76\u00ba, CLT).\u00a0\u00c9 a forma mais simples, por\u00e9m tamb\u00e9m a mais arriscada, uma vez que: dispensa acordo escrito; a compensa\u00e7\u00e3o deve ocorrer dentro do pr\u00f3prio m\u00eas; \u00e9 admitida para ajustes pontuais de jornada. Embora legalmente poss\u00edvel, a aus\u00eancia de documento escrito dificulta a defesa da empresa em caso de lit\u00edgio, j\u00e1 que a comprova\u00e7\u00e3o da compensa\u00e7\u00e3o depende de registros de ponto e de condutas reiteradas, o que raramente se sustenta perante a Justi\u00e7a do Trabalho. Para micro e pequenas empresas, os riscos decorrem menos da legisla\u00e7\u00e3o e mais da execu\u00e7\u00e3o pr\u00e1tica do regime. Erros simples, de baixo custo operacional, s\u00e3o suficientes para invalidar todo o sistema.\u00a0A seguir est\u00e3o os principais pontos de aten\u00e7\u00e3o.
